3. Privacy information
3.1 Controller
The controller for the processing of personal data through this Website is:
Oleg Fadeev, Vogesenstrasse 33, 4056 Basel, Switzerland Email for privacy matters: Show email address
No data protection officer has been appointed, since the applicable legal requirements for such an appointment are not met.
3.2 Applicable law
The processing described below is subject to the Swiss Federal Act on Data Protection (FADP) and, where the conditions of its Article 3 are met, to Regulation (EU) 2016/679 (GDPR).
3.3 Data processed
a) Server logs and content delivery network. The Website is hosted and delivered through the Cloudflare network. When you visit the Website, Cloudflare automatically processes technical data, in particular the IP address, the date and time of the request, the requested resource, the referring page, the browser type and version, the operating system and the amount of data transferred. This data is necessary to deliver the pages, to keep the service stable and to protect it against attacks.
b) Contact form. When you send a message, the following is processed: your name, your email address, the text of your message, the confirmation of the privacy checkbox, and the technical data associated with the submission (IP address, timestamp, anti-spam result).
c) Email correspondence. If you write directly by email, or once a reply is sent to a message from the contact form, the content of the correspondence and the associated metadata are processed and stored in the email mailbox.
d) Anti-spam verification. Cloudflare Turnstile processes technical data of the browser and of the session in order to verify that the form is not being submitted by an automated bot.
The Website does not use advertising cookies, marketing analytics, tracking pixels, remarketing or user profiling.
3.4 Purposes and legal bases
| Processing | Purpose | Legal basis (GDPR) |
|---|---|---|
| Server logs and CDN | Delivery of the Website, stability, IT security | Art. 6(1)(f): legitimate interest in operating a secure and functioning website |
| Contact form and reply | Reply to your enquiry and, where applicable, prepare a possible collaboration | Art. 6(1)(b): steps prior to entering into a contract, and Art. 6(1)(f): legitimate interest in responding to professional enquiries |
| Privacy checkbox on the form | Evidence that the information was provided before submission | Art. 6(1)(a): consent, and Art. 7(1) |
| Anti-spam verification | Protection of the form against abuse and automated submissions | Art. 6(1)(f): legitimate interest in preventing abuse |
| Retention of correspondence | Documentation of professional contacts and compliance with legal retention duties | Art. 6(1)(f) and Art. 6(1)(c) |
Under the FADP, the processing described above is ordinary processing carried out in good faith, for a purpose that is recognisable and proportionate to the enquiry you send.
You may withdraw your consent at any time with effect for the future, without affecting the lawfulness of the processing carried out before the withdrawal.
3.5 The provision of data is voluntary
You are not legally or contractually obliged to provide any data. The name, the email address and the message are, however, necessary in order to be able to reply. If you do not provide them, the enquiry cannot be processed.
3.6 Service providers
The following providers process data on behalf of the controller or in connection with the operation of the Website:
| Provider | Function | Location |
|---|---|---|
| Cloudflare, Inc. | Hosting of the Website, content delivery network, server logs, protection against attacks, Turnstile anti-spam verification and forwarding, through Email Routing, of mail addressed to the domain to the destination mailbox | United States, with a global network of servers that deliver content from the node closest to the visitor |
| Formspree, Inc. | Reception of the contact form and forwarding of the message by email. The service is configured not to retain submissions in the Formspree dashboard. Formspree hosts its service with Amazon Web Services in the United States | United States |
| Destination mailbox in which the correspondence is received and stored | United States and Ireland, depending on the applicable contracting entity |
The domain is registered through Soluciones Corporativas IP, S.L. (DonDominio), Manacor, Spain. The registrar processes the registrant's data for the administration of the domain and does not process the personal data of visitors to the Website.
Data processing agreements made available by Cloudflare and by Formspree are in force. The destination mailbox is operated through a Google mail service, subject to the terms of that service.
3.7 International transfers
Some of the providers listed above are established in the United States or may process data outside Switzerland and outside the European Economic Area.
These transfers take place on the basis of the mechanisms provided for in Articles 44 to 49 of the GDPR and in Articles 16 and 17 of the FADP, applied to each provider as follows:
- Cloudflare, Inc.: certified under the EU-U.S. Data Privacy Framework and under the Swiss-U.S. Data Privacy Framework, complemented by the standard contractual clauses of the European Commission.
- Formspree, Inc.: standard contractual clauses of the European Commission, recognised by the Federal Data Protection and Information Commissioner with the adaptations required for Switzerland.
- Google: certification under the EU-U.S. and Swiss-U.S. Data Privacy Framework, complemented by the standard contractual clauses.
Despite these safeguards, a level of protection equivalent to the Swiss and European one cannot be fully guaranteed in every destination country, in particular as regards access by public authorities.
3.8 Retention
- Server logs and CDN: for the periods applied by the providers for security and diagnostic purposes, generally short.
- Contact form submissions: Formspree is configured not to store submissions. The message is transmitted and forwarded by email without being retained in the provider's dashboard.
- Email correspondence: kept for as long as necessary to manage the professional relationship or the enquiry, normally up to 24 months after the last contact. Where a contractual relationship arises, the correspondence relating to it is kept for the statutory retention periods, which under Swiss law is 10 years for business records.
3.9 Security
The Website is served exclusively over an encrypted TLS connection. The submissions of the contact form are transmitted over an encrypted channel. Access to the mailbox and to the providers' accounts is protected by strong passwords and two-factor authentication. Ordinary email is not an end-to-end encrypted channel, which is why point 2.3 above asks you not to send confidential information through it.
3.10 Your rights
Under the GDPR, where it applies, you have the right of access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20), objection to processing based on legitimate interest (Art. 21) and withdrawal of consent (Art. 7(3)).
Under the FADP, you have the right of access (Art. 25), the right to obtain the correction, deletion or destruction of the data (Art. 32), the right to data portability (Art. 28) and the right to object to the processing.
To exercise these rights, write to Show email address. A reply will be provided within one month. Where verification of your identity is necessary in order to protect your own data, additional information may be requested.
The exercise of these rights is free of charge.
3.11 Supervisory authorities
If you consider that the processing infringes data protection law, you may lodge a complaint with:
- Switzerland: Federal Data Protection and Information Commissioner (FDPIC), Feldeggweg 1, 3003 Bern, www.edoeb.admin.ch
- European Economic Area: the supervisory authority of your country of residence, of your place of work or of the place of the alleged infringement.
3.12 Cookies and similar technologies
The Website does not set advertising, analytics or profiling cookies.
Only technically necessary elements are used: the storage of the acknowledgement of the privacy banner in your browser, and the cookies or tokens that Cloudflare Turnstile and the security services of Cloudflare need in order to verify the session and to protect the Website. These elements do not require your consent because they are strictly necessary for the requested service.
3.13 No automated decision-making
No automated individual decision-making, including profiling, within the meaning of Article 22 of the GDPR and Article 21 of the FADP takes place.
3.14 Minors
The Website is directed at professional audiences and is not intended for persons under 16 years of age. No data is knowingly collected from minors.

This notice may be updated to reflect changes in the services used, in the functionality of the Website or in the applicable law. Continued use of the Website after publication of a new version constitutes acknowledgement of that version.

5. Language versions
This page is published in English, Spanish and German. The versions are intended to be equivalent in content. In the event of any discrepancy or difference in interpretation between them, the English version prevails.
6. Applicable law and place of jurisdiction
This notice and the use of the Website are governed by Swiss law, without prejudice to the mandatory provisions of the law of the country of residence of consumers domiciled in the European Economic Area.
The place of jurisdiction is Basel-Stadt, Switzerland, insofar as no mandatory statutory place of jurisdiction applies.
